What Benefits are Available
There are currently seven claims that are
available to you through your statutory accident benefits. These benefits
- Income Replacement Benefits – This
provides 70% of your net income to a maximum of $400 per week and will only be
paid for two years. After this, you need to prove that your injury prevents you
- Non-Earner Benefits – This provides a
maximum of $185 per week for unemployed people, however it is not available
until six months after the accident.
- Caregiver Benefits – This provides a
maximum of $250 per week for a primary caregiver residing with the beneficiary
for catastrophic cases only.
- Housekeeping and Home Maintenance Benefits – This provides a maximum of $100 per week for no more than two years, but is only
available for catastrophic cases and is subject to interpretation.
- Attendant Care Benefits – This provides
$3,000 per month to a maximum of $36,000 over two years for non-catastrophic
cases. It provides $6,000 per month to a maximum of one million dollars over
the course of the victim's lifetime for catastrophic cases.
- Medical and Rehab Benefits – This
provides a maximum of $3,500 for minor injuries. Non-minor injuries come with a
maximum of $50,000. Catastrophic injuries are a maximum of one million dollars.
- Travel Benefits – This is paid to family
members who live with the victim during their recovery or therapy.
There are sometimes cases where you might
be able to claim additional benefits that are not listed above. In these cases,
it will be determined based on the circumstances of your accident and recovery,
and the quality of your lawyer
These benefits can include repairing or replacing glasses, clothing, lost education
and other circumstances.
